How to handle rent arrears

A documented process for checking the balance, contacting the tenant and deciding the next step.

When rent is missed, first reconcile the account and contact the tenant about the actual balance. This guide is about resolving and documenting arrears. The separate possession guide covers the legal route if the tenancy must end.

Check the account first

Confirm the due date, amount, bank reference, credits and any payment made by another person or organisation. Correct errors before sending an arrears notice. A clear rent schedule should show every charge, receipt and running balance.

Contact the tenant early

Use the agreed contact details and state the amount and period clearly. Ask whether there is a payment problem or administrative error. Avoid repeated contact, threats or visits that could become harassment.

Record an affordable agreement

If a payment plan is suitable, confirm the normal rent, extra payment, dates and review point in writing. Do not agree an amount that makes the current rent impossible to maintain. Keep the ledger updated after every payment.

Take legal advice before possession action

Rent arrears can be a ground for possession under the Section 8 process. The correct ground, evidence and notice period depend on the circumstances. Do not change locks or remove a tenant without a possession order and the lawful enforcement process.
